Note all orders are subject to the following terms and conditions:


Partnership Arrangement


Cool Approach (CA) and Yourdesign.co.uk (YD) are working in partnership to provide you with an ordering and printing service. CA is responsible for the ordering process and takes payment for all orders. We pass on all details, including personal details, submitted with your order to our partner YD only in order that YD can process the order and deliver the goods to you directly. This is outside the Data Protection agreement given in our Privacy Policy and by placing an order with CA, you agree to CA passing on your details to YD for the purpose of processing your order.


Once the order details have been sent to YD, then CA has no responsibility whatsoever with regard to the order and delivery process. YD is responsible for all queries once CA has sent the order confirmation email to you and you should contact YD directly for any such queries you may have.


Acceptance


All orders and transactions between CA and you are accepted on these conditions of sale and those of our partner YD (see http://www.yourdesign.co.uk/terms-and-conditions.php). It is your responsibility to read such conditions before entering upon a transaction.


Variations


CA may vary, without any liability, the content of the site, including quotations, sales literature or other documents as long as such alterations do not materially affect the quality of the goods.


Price


All prices quoted on CA website are in British Pounds Sterling and are inclusive of postage within the British Isles . CA is entitled to increase the price of goods at any time due to factors beyond our control, however once the product(s) has been confirmed, CA will honour the price as per our email to you.


Payment


You agree to pay for all goods at the point of order. Payment is to be made using the secure online server within CA website. In making payment you must be the account holder and ensure that sufficient funds are held to honour the payment.


Images


CA does not accept responsibility for the quality of any images sent to us (for details of image types to be submitted, please refer to http://www.yourdesign.co.uk/faq.php). Licensed or copyright images, logos or trademarks must not be submitted to CA by you for reprint without the consent of the owner. CA has the right to refuse any order if we deem the images unsuitable or in breech of copyright rules.

CA shall not be liable for any claim or expense arising out of any illegal or libellous matter printed for you or any infringement of copyright or patent or similar right resulting from compliance of your instructions either expressed or implied. Any legal costs incurred in such matter shall be borne by you. You agree to indemnify and hold us and our subsidiaries, affiliates, officers, directors and employees harmless from any claim or demand (including all reasonable professional fees) made by any third party to or arising out of your breach of any of these Terms or your violation of any law or the right of a third party.


Design Service


CA offers an On Line Service that is designed to provide you with the opportunity to view an illustration of your image on our products. YD shall then resize the image to provide you with a product of optimal quality. CA/YD accepts no responsibility for poor quality images submitted to us. The better the image supplied to CA the better the print.


Errors


CA does not accept responsibility for your input or for any spelling mistakes you make on orders.


Cancellations/Returns


No goods are sold to customers by CA/YD on a sale or return basis. The customer has no right to reject or return the goods without the consent of YD. As goods are personalised a 'cooling off' period is not applicable. Personalised items of clothing may not be exchanged or refunded should the customer request an incorrect size at time of order. Your statutory rights are not affected.


Alterations


YD shall endeavour to make amendments to requested orders as timely as possible. However if this request is received after the product has been printed neither CA nor YD shall not be liable for the cost of a reprint.


Delivery


CA has no responsibility regarding delivery of products. Any dates provided for delivery are approximate only, and YD is not responsible for the timely receipt of goods once dispatched to the customer. As such, late deliveries will not be refunded. Please note YD next day print and dispatch service is currently only applicable to gift orders, and is offered at the discretion of YD.


Orders not received within 4 working days of payment must be reported directly to YD by email. Failure to notify YD within this period will result in YD not accepting any responsibility for items dispatched and not delivered/received.


Delivery costs


The cost displayed throughout the CA site includes the cost of postage within the British Isles . Orders will be dispatched using Royal Mail or for larger parcels a Courier at the discretion of YD. Goods returned to YD described as undeliverable will be subject to a redelivery charge.


Overseas delivery


Postage outside the UK will be calculated during the checkout process. Parcels leaving the British Isles shall be identified with a customs label identifying the contents of the parcel. This may be examined by customs.


Damaged Goods


Damaged goods must be reported to YD within 48 hours of delivery by email. Failure to do so will mean that YD will not accept responsibility and the customer shall not be entitled to reject the goods.


Upon agreement by email YD will cover the cost for the return of the product(s) using either 1st or 2nd class post, or courier costs on larger orders. Products must be received by YD to qualify for a replacement free of charge. A refund may be considered at the discretion of YD. A refund or replacement will not be offered in the instance that an image of poor quality has been supplied by the customer to CA and printed by YD.


Colour and Sample Matching


YD will endeavour to match colours as closely as possible. Exact colour matching onto different substrates is not always possible and YD is unable to guarantee an exact match. As such the customer has no right to reject or return the goods on these grounds. Should the customer have concerns regarding the colour match on multiple orders of the same design YD recommends that a sample mug is obtained, to proceed without a sample is at the sole risk of the customer. All products are printed by hand, as such YD shall endeavour to match the colour, style and positioning on each item however YD is unable to guarantee an exact match.


Liability


Except in the case of death or personal injury caused by negligence on behalf of CA and YD, CA and YD will not be liable to you by reason of any representation, implied warranty, condition or other term, or any duty at common law, or under the express terms of the conditions for any consequential loss or damage (whether for loss or profit or otherwise), costs, expenses or other claims for consequential compensation whatsoever which arise out of, or in connection with the supply of the goods or their use or resale by you.


Force Majeure


CA and YD shall not be liable to you or be deemed to be in breach of the contract of sale for any delay in performing, or any failure to perform, any of CA/YD obligations in relation to the goods if the delay or failure was due to any reason beyond CA/YD reasonable control.


Jurisdiction


Any contract formed under these conditions of sale shall be construed and enforced in accordance with English Law in the Courts of England and Wales .
